Photo Compress by Saawan Apps

By downloading, installing, or using the Photo Compress mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms").
Throughout these Terms, Saawan Apps ("we," "us," "our," or the "Developer") refers to the independent individual software developer(s) and open-source contributor authors of the App. Saawan Apps is an independent software project and not an incorporated enterprise software provider. If you do not agree to these Terms, please do not download, install, or use the App.
You represent that you are at least 13 years of age. If you are under 13, you may not use the App.
Saawan Apps grants you a personal, non-exclusive, non-transferable, revocable license to use Photo Compress for your personal or lawful commercial photo editing, resizing, and compression needs, subject to these Terms.
You retain 100% of your ownership, rights, and intellectual property in all photos, images, and documents processed using Photo Compress. Saawan Apps does not claim any ownership rights over your media. Because all processing is performed entirely on your device, we do not access, view, copy, or store your original photos, working/modified photos, or PDF documents.
All rights, title, and interest in and to the App — including but not limited to its source code, object code, user interface design, visual assets, icons, trademarks, trade names ("Photo Compress," "Saawan Apps"), and documentation — are and shall remain the exclusive property of Saawan Apps and/or its licensors. These Terms do not grant you any rights to use the Saawan Apps name, logo, or branding.
Any suggestions, feedback, bug reports, or feature ideas you provide are submitted voluntarily. You grant Saawan Apps a non-exclusive, royalty-free, perpetual right to use feedback to improve the application. Feedback may be transmitted through our Google Cloud / Firebase backend or via email depending on App configuration (which may change without user consent or prior notification). User feedback records and any attached screenshots submitted via Firebase are hosted securely on Google Cloud / Firebase backend infrastructure and are subject to a 1-year (365-day) automated retention period as detailed in our Privacy Policy.
The App incorporates certain third-party open-source software components, each subject to its own license terms (such as the Apache License 2.0 or MIT License). A list of these components and their respective licenses is available within the App under Settings > Open-Source Licenses. Nothing in these Terms is intended to limit, restrict, or override the rights granted to you under such open-source licenses.

Photo Compress is supported by third-party advertising, including Google AdMob. Ads displayed in the App may contain links to external third-party websites, applications, or services. Saawan Apps does not control, endorse, or assume responsibility for the content, privacy policies, products, or practices of any third-party advertisers. Any interactions, purchases, or dealings with advertisers are solely between you and the applicable third party.
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Saawan Apps and its developer(s) do not warrant that:
We strongly recommend keeping backups of your original, uncompressed photos before performing any batch operations.
Language and Translations Disclaimer: Photo Compress may be localized into multiple languages on an experimental basis, with translations released as they become available. Non-English translations may be generated or assisted by automated tools, artificial intelligence (AI), or volunteer contributors, and are provided solely for convenience on an "AS IS" basis. We make no representations or warranties regarding the linguistic accuracy, completeness, or contextual suitability of any translated text. The English language version of the App and these Terms shall be the controlling and authoritative version. If any translation is inaccurate, awkward, or fails to meet your expectations or standards, your sole remedy is to switch the App language to English via App Settings or discontinue use of the App.
To the maximum extent permitted by applicable law, Saawan Apps, its independent developer(s), authors, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, photos, profits, or goodwill, arising from or related to your use of or inability to use the App.
In no event shall the total aggregate liability of Saawan Apps, its developer(s), authors, and contributors, for any and all claims arising out of or related to the App or these Terms, exceed the total amount actually paid by you directly to Saawan Apps for the App in the twelve (12) months immediately preceding the event giving rise to the claim.
Duty to Cease Use for Critical Defects: If you encounter any bug, defect, malfunction, or unexpected behavior that you consider critical to your workflow, device, or data integrity, you must immediately cease using the App for those operations to avoid potential data loss or adverse outcomes. Please report any such issues to our official support email.
You agree to indemnify, defend, and hold harmless Saawan Apps, its developer(s), authors, and contributors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party intellectual property or other rights while using the App.
Saawan Apps reserves the absolute right, at its sole discretion and at any time, to:
Any such action may be taken without prior notice, for any reason or no reason, and without any obligation to provide explanation, justification, or clarification. Saawan Apps and its developer(s) shall bear no liability or legal responsibility to you or any third party for any suspension, withdrawal, or discontinuation of the App or its distribution. Continued use of the App following any revisions constitutes your acceptance of the revised Terms.
Photo Compress is provided on a strictly best-effort basis. Any software updates, bug corrections, security patches, or compatibility adaptations for newer Android operating system versions are developed and released solely based on the independent developer's personal availability, resources, and effort. We provide no Service Level Agreement (SLA) and make no guarantees regarding update timeliness, frequency, or the indefinite continuation of maintenance.
The App provides feedback mechanisms via Firebase backend infrastructure and/or direct email communication (saawanapps@gmail.com). The App may use either of these channels based on its operational configuration, which may change without user consent or prior notification. The designated email address is the official channel for formal notices and technical inquiries.
Public app store ratings, reviews, social media mentions, or third-party discussion forums are non-primary channels, are not regularly monitored for diagnostic resolution, and do not constitute formal notice.
Saawan Apps reserves the right to respond to, prioritize, or decline any inquiry at its sole discretion. Submission of an inquiry does not guarantee a response or resolution.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the competent courts located in the State of Uttar Pradesh, India.
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute, claim, or controversy arising from or related to the App or these Terms informally by contacting Saawan Apps at saawanapps@gmail.com. You agree to allow a period of at least thirty (30) days from the date of your written notice for informal resolution before pursuing any other remedy.
Class Action Waiver: To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Saawan Apps.
Severability: If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Saawan Apps regarding the App and supersede all prior or contemporaneous agreements, understandings, negotiations, and discussions, whether written or oral.
No Waiver: The failure of Saawan Apps to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by Saawan Apps.
Assignment: Saawan Apps may assign, transfer, or delegate its rights and obligations under these Terms without restriction. You may not assign or transfer your rights or obligations without our prior written consent.
Force Majeure: Saawan Apps shall not be liable for any delay or failure to perform any obligation under these Terms where the delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, governmental actions, power failure, internet or telecommunications failure, or third-party service outages.
Termination: Saawan Apps reserves the right to terminate or suspend your license to use the App at any time, for any reason, without prior notice. Upon termination, all rights granted to you under these Terms shall immediately cease, and you must uninstall and delete all copies of the App.
